Special Needs Trusts

A person who requires public financial support due to a disability is
required to be practically impoverished in order to qualify for that support.
Loved ones who want to share gifts with a person living with a disability
have to be very careful that their gifts do not cause that person to become
dis-enrolled from the necessary programs.  An unexpected inheritance,
given with all the best intentions, can be irretrievably lost through this system.

At Futurity Legal Services, we can create a Supplemental Needs Trust that is designed to allow the person with a disability to receive gifts in a way that does not jeopardize his or her government assistance.  Or we can create a Special Needs Trust for other types of income.  Such trusts are authorized by the Medicaid laws for that purpose.  We know that complex legal instruments are not always necessary for these situations, and we strive to keep it simple.
